OFC Survey Giveaway Rules & Eligibility Requirements
Set forth below are the rules and eligibility requirements for the OFC Conference and Exhibition Survey (“Giveaway”)
- Agreement to the Official Rules: By entering this Giveaway, you agree to be bound by these rules and the decisions of OFC Management, which are final and binding in all matters related to the Giveaway. Winning any prize is contingent upon fulfilling all requirements of the Giveaway. You may be disqualified, in OFC Management’s sole discretion, if you fail to comply with any term or condition set forth herein. OFC Management reserves the right to cancel or suspend the Giveaway and to modify or amend these rules at any time in OFC Management’s sole discretion.
- Eligibility: This Giveaway is open only to those individuals who enter on or between the dates of 28 March 2024 and 11 April 2024 (the “Entry Period”) and who are at least 18 years of age on the date of entry. Employees, directors, and officers of OFC Management and The OFC Management Foundation and their immediate families are not eligible to enter. This Giveaway is open to legal residents of the United States and may be open to individuals residing outside the United States. ALL PARTICIPANTS ARE REQUIRED TO DETERMINE FOR THEMSELVES WHETHER THERE IS ANY LEGAL OR OTHER REQUIREMENT OF THEIR NATIONAL, REGIONAL OR LOCAL JURISDICTION THAT WOULD FORBID THEIR PARTICIPATION IN THIS GIVEAWAY. This Giveaway is void where prohibited by law.
- Entry Requirements: No donation or purchase is required. To enter the Giveaway, you must complete and submit the OFC Conference and Exhibition Survey and provide your contact information during the Entry Period. By submitting an entry, you agree to receive communications from OFC Management at the address you provide and you agree to the terms set forth in OFC Management’s privacy policy, which is located at: https://www.OFC Management.org/en-us/about/policies/privacy_policy/. OFC Management shall determine, in its sole discretion, whether the entry requirements have been met. One (1) submission is allowed per person. If you submit more than one submission, both will be disqualified. Once submitted, your entry in the Giveaway is final and cannot be changed. OFC Management shall not be liable for any entries or prizes that are lost, stolen, late, misdirected or undelivered for any reason whatsoever. Proof of online entry will not be deemed proof of receipt of your entry by OFC Management. All entries become the property of OFC Management and will not be acknowledged or returned.
- Winner Selection: OFC Management will randomly select the Winner(s) on or about 18 April 2024. The odds of winning depends upon the number of entrants. The winner will be notified by email within 30 days after the random drawing. The Winner(s) will be contacted to confirm the mailing address within 25 days after the Winner(s) are chosen. If OFC Management is unable to contact the Winner(s) due to a change in the contact information initially provided, the Winner(s) will be disqualified. OFC Management shall be responsible for the cost of delivering the prize. No substitution or cash equivalent is allowed. In order to be confirmed as an official Winner of the Giveaway, the Winner(s) shall complete an affidavit of eligibility and acceptance if requested to do so by OFC Management.
- Permissions: Acceptance of a prize constitutes your permission for OFC Management to use your name, hometown and likeness for promotional, advertising, and marketing purposes with regard to the Giveaway in any media throughout the world and without additional payment or consideration to you. You further understand and agree that all information provided by you in the form of answers to survey questions becomes the intellectual property of OFC Management and can be used as part of an industry, company-specific or other type of analysis or report, which may or may not be published or disseminated to OFC Management members or the general public.
- Prize Restrictions and Taxes: Prizes may not be transferred or assigned. The Winner(s) will be responsible for all applicable taxes on the prize (including but not limited to federal, regional, local and/or income taxes) and compliance with all legal and reporting requirements of the country, region and local jurisdiction where they reside. United States residents shall provide their social security numbers solely for tax reporting purposes if the retail value of the prize being awarded is $600 or greater (as determined in OFC Management’s sole discretion), and OFC Management will file an IRS Form 1099 with the Internal Revenue Service. OFC Management reserves the right, in OFC Management’s sole discretion, to require entrants and the Winner(s) to provide proof of identity and residency for their entry to be considered valid or to claim a prize.
- Compliance with Law: You shall comply with all applicable laws, regulations, ordinances, and executive orders of any country, state, municipality or government body applicable to the Giveaway and your participation in the Giveaway.
- Indemnification: You agree to indemnify, defend and hold harmless OFC Management and OFC Management’s directors, officers, agents and employees from and against any and all claims, demands, actions, litigation, investigations and proceedings arising out of or related to: (a) your participation in the Giveaway (including the award of a prize to you); (b) your obligation to pay taxes associated with any prize awarded to you; (c) any misrepresentation by you regarding your eligibility to participate in the Giveaway; and (d) your breach of these rules.
- Release & Limitation of Liability: You shall have no claim against OFC Management or its directors, officers, agents and employees for any incorrect transmission of information, human error, technical malfunction of computer hardware or software, network or internet failures, inability to access OFC Management’s website or other online service, inability to establish communications, non-delivered communications, lost or delayed data transmission or other similar omissions, interruptions, defects, malfunctions or errors related in any way to your participation in the Giveaway, regardless of cause. OFC Management makes no warranty, representation or guarantee, express or implied, with regard to the Giveaway or the prize. By participating in the Giveaway, you agree to release, hold harmless and forever discharge OFC Management and its directors, officers, agents, and employees from any and all liability for any claims, causes of action, injury to person or property, violation of right to publicity or privacy, reputational harm, costs, losses, penalties, fines, judgments or other damages of any kind related in any way, either directly or indirectly, to your participation in the Giveaway. IN NO EVENT WILL OFC MANAGEMENT BE RESPONSIBLE OR LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING EITHER DIRECTLY OR INDIRECTLY FROM YOUR PARTICIPATION IN THE GIVEAWAY. OFC MANAGEMENT’S MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT OF THE PRIZE. ANY CLAIM AGAINST OFC MANAGEMENT NOT MADE WITHIN ONE (1) YEAR FROM THE CLOSE ENTRY PERIOD SHALL BE WAIVED AND FOREVER BARRED.
- Unauthorized Intervention: OFC Management shall not be liable for unauthorized human intervention in any part of the entry process. Any attempt by you or any individual to deliberately damage any website, tamper with the entry process, or otherwise undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws and should such an attempt be made, OFC Management reserves the right to cooperate in the prosecution of any such individual(s) and to pursue all civil and criminal remedies to the fullest extent permitted by law.
- Choice of Law and Jurisdiction: The Giveaway and all matters related thereto shall be governed by the laws of the District of Columbia, and any and all claims, disputes and causes of action related to the Giveaway shall be resolved individually, without resort to any form of class action in the federal or state courts located in the District of Columbia. By participating in the Giveaway, you further agree to waive your right to a jury trial with regard to any and all claims related thereto.
